Given the sheer scale of Big Ideas that Close Encounters of the Third Kind fits into its runtime, it stands to reason that it probably went through a few drafts to iron out the details. But the first few versions were … very different from what ended up onscreen. The original treatment had flying saucers landing in the middle of Los Angeles. A version written by writer-director Paul Schrader was “one of the most embarrassing screenplays ever professionally turned in to a major film studio or director,” according to Steven Spielberg, and followed an Air Force officer hired by Project Blue Book to debunk UFO conspiracy theories — until one day he makes contact. Understandably, this did not have the sort of emotional juice Spielberg was hoping for, and eventually he and the studio landed on the much more grounded child abduction plot and went from there.

David Lynch’s The Elephant Man, a biopic about Joseph Merrick, a man with significant physical deformities who nonetheless was an accomplished artist and member of society in the late 1800s, seems like another of Lynch’s one-in-a-million movie plots. But, oops, it turned out that there was a stage play with the same title and about the same subject that opened only a few years before production on Lynch’s film was set to begin. The producers of the play ended up suing the film production before filming began, and though they allowed the film to be made, The Elephant Man had to pay the play an undisclosed amount of money, and ads for the movie had to have a disclaimer telling audiences that the movie was not based on or affiliated with the play in any way.
